MINUTES OF THE PUBLIC MEETING OF JULY 12TH, 2005

Called to Order at 7:35 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5. by Craig Nicholson, Clerk, in Meeting Room A at the Town Hall.

Public Hearings

7:45 PM  Abbreviated Notice of Resource Area Delineation to confirm the accuracy of a wetland delineation done at 208 Elm Street, Map 36, Lot 4 for John Webby, Ridgewood Custom Homes, P.O. Box 1663, Sagamore Beach, MA  02562 represented by Bennett Engineering, P.O. Box 297, Sagamore Beach, MA  (DEP #175-___)  (New Hearing)

David Harris read the public hearing notice and the abutters list was verified.  Thomas Roux of Bennett Engineering made the presentation.  He submitted a revised plan according to the suggestions made by the Commission’s review engineer, Dr. Walter Hewitson.   Ms. Delaney commented that the revised plan showed a road structure and that if an ANRAD is voted on it should be made clear that the road is not being approved, only the wetland delineation.   There is an intermittent stream and a pond delineated on the plan.  (Mr. Lindquist came into the meeting at this point.)   However, they are not asking for confirmation of the stream, only the Bordering Vegetated Wetland.  The abutters list was read off.  Those present were:

Bob Emory of the Hanson Rod & Gun Club:  Had a question about whether wetlands were being increased or decreased.  Mr. Nicholson answered that we were just trying to identify the existing wetland line at this point, nothing is being proposed.

Sally Ann Stahl of 188 Elm Street:  Wanted to know how it would affect the stream.   Would go into her pond.
June Allen of 205 Elm Street:  Wanted to make sure the water stays going.
Janet & Joel Warren of 133 Elm Street:  Wanted to know what the project was.  Is it a subdivision?  Mr. Nicholson answered that they will have to come back for that and there will be future hearings.
Jean Dean of 162 Elm Street:  Wanted to see the plan.  How big is the parcel.
Joseph Deminico of 274 Elm Street:  Has no objection as long as the water keeps flowing.

Mr. Nicholson suggested that Mr. Roux submit a revised plan so that the roadway is not being shown.

8:00 PM  Notice of Intent  for a resource improvement that includes scooping out metal items from the wetlands and removing a layer of sawdust/chips and bark along with an invasive species of bamboo from the parking lot at 1125 Main St., Map 43, Lot 34 for Allan Clemons, 671 Indian Head St., Hanson, MA  (New Hearing)  (DEP #175-0474)

David Harris read the public hearing notice and the abutters list was verified.  Mr. Clemons made the presentation.  The wetland was delineated by Sharon LePorte.  He would like to do some remedial work by pulling items out of the wetland.  The proposal calls for a gravel parking lot, no blacktop.  Haybales and silt fence are proposed.  The Commission decided that a silt fence would be sufficient.  Ms. Delaney suggested that the slope is stabilized with a conservation seed mix.

8:15 PM Notice of Intent the construction of a septic system, grading and landscaping at 751 Whitman St., Map 109, Lot 3 for Joanne Slaney represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (New Hearing)  (DEP #175-0473)

David Harris read the public hearing notice and the abutters list was verified.  Mr. Bernard Munro made the presentation for the septic repair.  Haybales are proposed around the entire work area.  There is some slight grading within the buffer zone.  Ms. Delaney had inspected.   The offsite wetland line looked to be visually accurate.  After talking with the DEP

today, she was surprised to learn that the Commission can, if so inclined, issue a Negative Determination on a NOI filing for a septic improvement.  It can save the applicant money in the long run and the contractor follows the plan of record.

Dave Harris read the public hearing notice and the abutters list for all three lots was verified.  Mr. Munro made the presentation.  Coleman Earner was present.  Ms. Delaney had prepared a memo  questioning the type of bogs that were shown on the plan.   They were shown as upland, but in the field had wetland characteristics.  Mr. Munro, after conferring with the DEP came to the conclusion that because there was no historical proof to demonstrate that they are upland, the bogs, for these purposes, are to be considered wetland.  Therefore, the applicant was asking for a variance for grading within the 50-foot buffer zone.  The existing bog roads will be used for access driveways.  Mr. Earner said that the bogs have not been maintained for seven years.  The proposal runs in conjunction with a previous filing for improvements to Lakeside Road.  Mr. Lindquist read off the list for abutters.  Those present were:

Doris Carlin of 397 Cross Street:  Wanted to know the difference between the 100 and 50-foot lines on the plan.  Mr. Lindquist answered that the Commission has jurisdiction within 100 feet of a wetland and there is a local by-law prohibiting construction within the 50-foot buffer.  Ms. Carlin wanted to know where the drainage would go and had concerns with displacing the groundwater.  Mr. Munro answered that most of the runoff would go into the bogs and towards the road.  
Joan Dilillo of 95 Rollercoaster Road:  Has not objection to this project.  She presumes the water will go towards Lakeside Road.  The back corner of her neighbor’s property has severe wet water and overflows onto the roadway of Mr. Earners road bog.  It comes off like a faucet.  Where is that water going to go?   Mr. Munro answered it will go into the bogs and across

Lakeside Road.  The rehab of the road will not change anything, it will still drain the same way.  Ms. Dilillo wanted to know if there were three separate driveways.  Also, will the road improvement only extend to the pump house.  The answer to both questions was yes.

Fred Johnson of 217 Lakeside Road:  In favor of the project.
John Bailey of 257 Lakeside Road:  Also in favor of the project.  

Mr. Lindquist asked that the drawings are revised to conform to the 50-foot buffer zone.  A decision should be made as to allow a variance for some grading and to allow the use of the bog roads as driveways.

9:15 PM Continued Notice of Intent for the construction of an above-ground swimming pool at 4 Joshua Lane, Assessor’s Map 37, Lot 1-15 for Donna Terrell    (DEP #SE175-0467)

Ms. Terrell was not able to attend the hearing tonight.  A revised plan had not been submitted.  The original plan showed the pool virtually in the wetlands.  Ms. Delaney suggested that a permit is issued provided a revised plan is submitted showing the pool 50’ from the wetland.

9:30 PM Continued Notice of Intent for the construction of a 17,000 sq. ft. office/warehouse with associated site access, grading and utilities on the existing vacant lot at Industrial Blvd., Map 59, Lots 17-7 and 17-8 for Jack McGrail, J & G Mgmt., LLC, 162 Industrial Blvd. represented by Coneco Engineers & Scientists, 4 First St., Bridgewater, MA  02324  (DEP #SE175-0466)   

 Joe Harnois of Coneco Engineers attended along with Jack McGrail, owner.  Mr. Harnois responded to the consultant review made by Tom Sexton.  Mr. Harnois agreed with five of his points and thought the others were superfluous.  Ms. Delaney suggested that at the very least, he submit revised plans showing a 1) crushed stone entrance to the driveway. 2) The O & M plans should have a contact name and telephone number.  3) The dumpster area should be shown on the plan.  4)  Spot elevations be added.  5) Submit a Request for Variance for the driveway.

9:45 PM Appointment with Michael and Patrice Boussy regarding a question about a Building Permit Application.

The Boussy’s asked the Commission whether it was possible to put a pool in their backyard as it is in close proximity to the wetlands.  Their house was built in 1994.  Ms. Delaney and Ms. Nehiley will research the By-law to see when the 50-setback went into effect.

Rain Barrel Program – This had been all organized through the Streetsweeper grant and NE Rainbarrel Co. and spearheaded by Janine Delaney.  Townspeople can order the barrels through NE Rainbarrel and there will be two pickup dates this month.
